(“we,” “us,” “our”), a Virginia-based recruiting company, connects candidates to job opportunities via our website (missionboxsolutions.com) and an Applicant Tracking System (“ATS”) operated by a third-party provider. By submitting personal data (e.g., resume, contact information) or using our services, you (“you,” “candidate”) agree to these Terms and Conditions (“T&C”), which govern our collection, use, and protection of your data.
 

2. Data Collection and Use
We collect personal data you provide - e.g., full name, email address, phone number, resume, job history, and other details - for recruitment purposes, including matching you to job openings, contacting you about opportunities, and maintaining a candidate pool for future roles. This data is processed and stored through our third-party ATS. You may request deletion by emailing info@missionboxsolutions.com - we’ll comply unless legally required to retain it.
 

3. Security Measures and Disclaimer
We implement reasonable security measures - e.g., access controls, password protections, and system monitoring - to safeguard your data. However, no online system is entirely secure. Our ATS is managed by a third-party provider whose security practices we rely on but do not control. We cannot guarantee that breaches, unauthorized access, or data loss will not occur despite our efforts.
 

4. Limitation of Liability
To the fullest extent permitted by Virginia law, we are not liable for any damages - direct, indirect, incidental, consequential (e.g., financial loss, identity theft), or punitive - arising from security breaches, data loss, or unauthorized access to your data, unless caused by our gross negligence (defined as willful or reckless disregard of our duties). Our liability, if any, is capped at $50 per candidate. You acknowledge and assume the inherent risks of submitting data online.

We are not responsible for breaches, failures, or losses caused by these providers (e.g., system vulnerabilities, inadequate safeguards). Their terms and policies govern their obligations - we will cooperate in addressing issues but disclaim liability for their actions or inactions.
 

6. Your Responsibilities
You are responsible for securing your devices, accounts, and credentials - e.g., using strong passwords, not sharing login details, and avoiding phishing links or suspicious downloads. Failure to take reasonable precautions may limit our liability for resulting breaches or losses.
 

7. Breach Notification
If we detect a breach affecting your data, we will notify you via email within legally required timeframes applicable to your jurisdiction—or sooner if feasible - without admitting fault. We may post updates at missionboxsolutions.com. You should monitor your accounts and report issues to applicable authorities (e.g., IdentityTheft.gov).
 

8. Governing Law and Jurisdiction
These T&C are governed by the laws of the Commonwealth of Virginia, excluding conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts of Warren County, Virginia, unless otherwise required by applicable law.
